EU Law for Cookie Policy

EU law states that organisations using cookies on their websites must inform users about cookies and obtain their consent for using them.

The EU’s E-Privacy Directive of 2002 required website visitors to be given certain information about cookies. From 26 May 2011 the law changed, requiring users to give consent before cookies are placed on their devices.

In the UK, the laws that give effect to the EU legislation are the Privacy and Electronic Communications Regulations (PECR) 2003, as amended in 2011.

From 25 May 2018, the General Data Protection Regulation (GDPR) came into force. It states that consent for data processing must be given through a clear affirmative action and must be:

  • Freely given
  • Specific
  • Informed
  • Unambiguous

Users should therefore be given a genuine choice regarding the cookies used while browsing the website, especially cookies other than strictly necessary cookies.

Consent Requirements

In addition to fulfilling consent requirements, information should also be provided through a privacy policy or data protection notice.

The ICO guidance suggests a number of ways websites may obtain user consent for cookies:

  • Pop-ups or banners requesting cookie consent.
  • Preference settings allowing users to control cookie functionality.
  • Website features such as videos or interactive tools requesting permission before activation.
  • Footer or header notices informing users about analytics cookies.
  • Additional notices for third-party cookies and advertising cookies.

Cookies should not be placed until the user takes some form of positive action on the website.

Cookie Management Tools

To comply with GDPR consent requirements, many organisations now use cookie management platforms or privacy management software.

These tools allow users to:

  • Accept or reject analytical cookies
  • Control marketing or advertising cookies
  • Update cookie preferences at any time
  • Withdraw consent easily

Such tools also allow website owners to record and manage consent preferences appropriately.

Non-Cookie Websites

Some businesses may consider using non-cookie websites, especially brochure-style websites without login or e-commerce functionality.

However, websites without cookies may face limitations such as:

  • Reduced analytics and visitor tracking
  • Limited personalisation features
  • Reduced advertising functionality
  • Competitive disadvantages compared to other websites

Website owners should carefully consider what works best for their business, website functionality and compliance requirements.
